Your use of this website (www.rowwellbeing.com, “we”, “our” or “us”) for Revolutionaries of Wellbeing Group Ltd, and purchase of any services or products through this website, is governed by the following terms and conditions, including both Section A and Section B clauses:

General disclaimer: The information contained in this website is for general information purposes only. The information is provided by Revolutionaries of Wellbeing Group Ltd (ROW) and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Through this website you are able to link to other websites which are not under the control of Revolutionaries of Wellbeing. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the website up and running smoothly. However, ROW takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

New Zealand law applies to use of this website, and all transactions.

Privacy: This privacy policy sets out how Revolutionaries of Wellbeing uses and protects any information that you give Revolutionaries of Wellbeing when you use this website.

Revolutionaries of Wellbeing is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Revolutionaries of Wellbeing may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 28 May 2012.

We may collect the following information: name, contact information including email address, demographic information such as city, preferences and interests, other information relevant to customer surveys and/or offers.

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping.
  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email to do so. We may use the information to customise the website according to your interests.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable procedures to safeguard and secure the information we collect online.

We will never, ever sell your contact information. We feel strongly that it would be unethical, and against the values of ROW.

Revolutionaries of Wellbeing also reserves the right to use cookies. A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences. We use traffic log cookies to identify which pages are being used. This helps us analyse data about webpage traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes.

Overall, cookies help us provide you with a better website by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the website.

If we use your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us using the contact form on our website. We will also always include an ‘opt-out’ in our direct marketing material. We will not sell, distribute or lease your personal information to third parties unless required by law to do so.

You may request details of personal information which we hold about you under New Zealand law. If you would like a copy of the information held on you please contact us using the contact form on our website. If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible using the contact form on our website. We will promptly correct any information found to be incorrect.

Intellectual property:  The design of, and content contained within, our website, and each of the various trademarks, company names, logos, product names and product images represented on our website are intellectual property which is either owned by us or licensed to us by suppliers or other third parties and must not be reproduced, copied, removed, altered, used, adapted, performed in public or transmitted in any form by any process (graphic, electronic or mechanical, including further copying, recording, taping or by a storage and information retrieval system) without our express permission.  All rights are reserved by the original copyright owners.

The products sold on this website are intended solely for non-commercial use: being no service or product may copied or on-sold to third parties.

Section B: Product/Service terms

In addition to Section A, the following terms and conditions of sale apply to all purchases by you through our website. This includes services such as professional development courses, and items that can be downloaded for free.  By completing a purchase, enroling or registering in a course, or downloading items from our website you are stating that you agree to be bound by all of these terms and conditions.

 

B.1. ROW Gold

Membership: ROW Gold is for individual members. It is not an organizational membership. Your membership remains with you, regardless of your employment or who funds your membership. The membership year is 12 months from the date of your application or renewal with membership fees for new members due at time of your application. It is your responsibility to keep ROW Gold informed of any changes of address and other contact information.

Payment: Credit card payments can be made through our secure payment gateway provider Windcave. We do not store credit card numbers on our site. Invoices may be paid by credit card and internet banking and are due within 14 days. Please ensure you include the invoice number as your reference with your payment.

Renewal: ROW Gold membership will commence on the date on which your application is received and your fees will cover the 12 month period. One month prior to your renewal date you will be invoiced for the next year’s fee at the rate then applying.

Overdue accounts: Overdue accounts are deemed to be those accounts that remain unpaid after thirty days from the date of invoice. Your ROW Gold membership will be disabled after two months from the date of invoice.

Resignation: A member may resign their membership by notifying Revolutionaries of Wellbeing in writing via our contact us page. If any monies are due to ROW Gold at date of resignation, they remain payable. To avoid being invoiced for the next membership year please submit your resignation ideally no later than the month before your renewal month, as invoices are automatically generated 1 month prior to your renewal date for the following membership year. For resignations during the term of membership, there are no partial refunds.

Personal data: To ensure that we can communicate with you, share knowledge amongst members, organise events, share updates, and plan for the future of the group, we need to collect different types of information, including personal data. As the hosts of the group, we are very protective and want to make sure you feel it is a safe place to share. Please note:

  • in terms of contact details, we will only ever ask for the information we need to know. This is held securely on our customer service platform.
  • email is the primary method of communication between ROW Gold and its members, including event notices, membership information, and annual membership invoicing.
  • as part of the group, we may ask you questions that relate to wellbeing in your workplace. It is up to you how much you want to share. We will collect and use the data you share with us transparently, honestly and fairly.
  • we will always respect your choices around the data that you share with us and the confidentiality. You are welcome to change this information at any time. Please email: together@rowwellbeing.com.
  • we will put appropriate security measures in place to protect the personal data that you share.
  • we do enable advertisers to promote their products, services and events on ROW Gold. ROW Gold data shared with advertisers will be aggregated (for example, number of clicks on an advertisement) to protect your privacy.

Under no circumstances will Revolutionaries of Wellbeing and each author of this website be liable for any indirect, incidental, special or consequential damages, including damages for loss of business or other profits, arising in relation to the use of any material from this website in any way whatsoever whether caused by the negligence of Revolutionaries of Wellbeing or otherwise.

Revolutionaries of Wellbeing does not represent or guarantee that any files obtained from or through this site are free from computer viruses or other defects. Any such files are provided, and may only be used, on the basis that the user assumes all responsibility for any loss, damage or consequence resulting directly or indirectly from use of those files.

Social network: As a group, ROW Gold relies on the trust and respect of members. As a member of the group, you agree to uphold these standards, and the following:

  • All discussions must relate to workplace wellbeing and be focused on creating workplace cultures that are positive and inclusive.
  • Membership to the group is at Revolutionaries of Wellbeing’s sole discretion. We love having a wide and varied group and but will exercise our discretion to remove members when needed if members impose on the supportive nature of the group.
  • We ask members to follow the Chatham House Rule with regards to sharing information gained from any discussions unless granted permission. Where a member is removed by Revolutionaries of Wellbeing, no refund will be offered.
  • From time to time, it may be possible to see others’ email addresses. Please be respectful of this information. Members are welcome to make contact between each other on a one-to-one basis.
  • Sending multiple unsolicited emails to members is not allowed and anyone found doing so will be removed from the group.
  • It’s great to hear case studies and to celebrate wins within the group (e.g. if your organisation has won an award – let us know!). However, to protect the purpose and intent of the group, we won’t tolerate spam or selling of services/goods (without Revolutionaries of Wellbeing’s prior approval) and will remove any member from the group that focuses on self or organisational promotion without permission.

Accounts:  Registering on the ROW LearnWorld website requires a username and password. You are responsible for all activities that occur under your user account, including the accuracy, quality, integrity, legality, reliability, and appropriateness of all data you provide, the confidentiality of your password and user account information. You must make reasonable efforts to prevent unauthorised access to or use of your account. The account is for your use only. By registering on our website, you consent to receiving marketing, promotional and other material from us. We may, at our sole discretion, suspend or terminate your account and limit your access to our website if we reasonably believe that to be necessary.

 

B.2. Products for Purchase

Product information:  We have made every effort to ensure products, such as the Self Care Cards, are featured as accurately as possible. The device you use to view our website may impact on the display of our products. Measurements provided on our website are approximate only. We do not guarantee that the colour, texture or detail of product shown on your screen will accurately reflect the actual product.  We reserve the right to change any aspect of our product information (including price) at any time without notice.

Prices:  We will charge you the retail price shown on the website at the time you submit your order, together with any additional handling and delivery fees. Prices are displayed in New Zealand dollars, exclusive of goods and services tax (GST) where applicable. We have made every effort to provide accurate pricing information on our website. Where the pricing error is reasonably obvious we may cancel any orders through our website.

Stock availability:  Products displayed on our website are subject to availability. We endeavour to provide accurate stock availability information on our website, however occasionally a product may appear to be “in stock” when it is not available.

Acceptance of orders:  Dispatch of orders is subject to stock availability and you will be advised if a product is unavailable.  To the maximum extent permitted by law, we will not be liable to any person if we decline to fulfil, or are unable to fulfil, an order.

Payment:  Payment for products online can be made by credit card (NZ$). Credit card payments can be made through our secure payment gateway provider Windcave. We do not store credit card numbers on our site

Delivery:  We currently ship internationally. If you live outside New Zealand, you are responsible for all duty and customs charges incurred in shipping your goods. Due to restrictions, we may not be able to ship to some countries and will advise if we cannot fill your order. Delivery charge will be advised at time of order. You must make sure that the delivery address and receiver’s name for your order are accurate and complete (including any business name if you ask us to deliver to a work address) because we may be unable to change these details once the order has been placed.  We cannot take responsibility for any orders that go missing due to incorrect delivery information provided by you, or because you have not chosen a safe delivery address. Delivery will be deemed to have been made when the goods arrive at the delivery point agreed with you, or, if you are to arrange delivery, when the goods are available for collection by you.

We will notify you when your order has been dispatched. Once an order is sent, it normally takes 2-5 business days to be delivered to New Zealand addresses. International shipping times can vary greatly so we will provide you with tracking information that will enable you to check on the progress of your parcel. We use New Zealand Post. Deliveries are made during standard weekday business hours and a signature is not required on delivery.  If you wish to request a particular location at your delivery address for the parcel to be left please enter a brief note in the delivery instructions field.  New Zealand Post is unable to guarantee full compliance with these instructions, but where possible will endeavour to fulfil your request. Unfortunately, requests to deliver on a certain day or time cannot be accommodated. You must notify us within 10 days of the dispatch date (as stated in the email we send confirming dispatch) if you have not received an item.  It is your responsibility to take care of the goods when they have been delivered in accordance with the instructions you have given us.

Liability:  If you buy goods or services from us for personal use, the guarantees set out in the Consumer Guarantees Act 1993 will apply to those goods or services. If you buy goods or services for business use, then we exclude all warranties, representations or conditions in relation to the goods and/or services provided by us implied by law, trade, custom or otherwise and our liability for any claim, damages, loss or expense related to the supply or use of goods or services is limited to the cost paid by you for those goods or services and we will not be liable,  whether in contract, tort (including negligence) or otherwise for any business losses including indirect, consequential or special loss or damage, loss of profits, loss of data, loss of savings and loss of opportunity.

Returns:  Please choose carefully, as we do not refund if you change your mind or if you made a mistake when ordering from the website. If the product returned is faulty, we will meet our obligation to provide a remedy under the “Consumer Guarantees Act”. We do not offer exchanges.

Cancellations: If you wish to cancel your order, please contact us as soon as possible. It is not possible to cancel your order once it has been dispatched. This includes digital downloadable files.

Product damage: Should any damage be found after signing for the products due to the damage being concealed (i.e. not obvious due to packaging) you must notify ROW within 24 hours of delivery. We can discuss replacement or refund options, and collection of the damaged item and return it to us.

Digital file use: Digital products are for personal use only, and not for commercial use (you can not alter and then re-sell the images). Digital products, such as the posters, are available as a compressed file to download. No physical item will be shipped.

 

B.3. Wellbeing Intensive Leadership Development (WILD) – public course

Services: Wellbeing Intensive Leadership Development (WILD) is a training program (the “Program”). The course description is intended to indicate the general nature of the Program and does not guarantee specific content. ROW reserves the right to amend the course and alter details to ensure the quality and intent of the course are met.

Enrolment fee: The enrolment fee is due at the time of registration. It must be paid in full on or before the enrolment closing date. If the fee is not paid by then, you will be notified, and your enrolment will be withdrawn.

Payment: The preferred method of payment is by credit card. Credit card payments can be made through our secure payment gateway provider Windcave. We do not store credit card numbers on our site. Invoices may be issued on request. Invoices may be paid by credit card or internet banking and are due within 14 days or before the enrolment closing date, whichever is sooner. Please ensure you include the invoice number as your reference with your payment when paying by invoice.

Enrolment closing date: The closing date for enrolments is advertised on the webpage for the public course, under the ‘Enrolment’ section.

Commencement: The Program commencement date is considered the initial briefing session, held before the core modules.

Certificate of Completion: To earn a Program Certificate of Completion, participants need to:

  • Attend and participate in five out of the six live online workshops, and
  • Attend and participate in four out of the five peer learning sessions with one member of the group providing a record of the meeting discussion by the due date, and
  • Complete all the action learning assignments, which must be sent by the due date.

Extensions to assignments and compassionate consideration for workshop and peer learning attendance may be permitted on a case-by-case basis but are solely at our discretion.

Cancellations and changes: Name changes can be made at any time at no cost prior to the commencement of the program. Enrolments cannot be transferred to another person once the program has begun. Once purchased, your enrolment in the Program is non-refundable. However, the value of the purchase may be held in credit for 12 months for another event or service provided by ROW. ROW reserves the right to change the date and/or presenters in the Program at any time and without prior notice, and in any way deemed to be in the best interests of meeting the objectives of the Program. ROW may cancel the course at its discretion. If ROW cancels the Program for any reason, your remedy is limited to a refund of the enrolment fee.

Privacy: ROW requires your personal information to allow attendance in the Program. If the mandatory personal information requested is not provided, you will not be able to participate and attend the Program. ROW is bound by the Privacy Act 2020. By registering for the event, you consent to the collection and processing of your personal information in accordance with ROW’s Privacy Policy, as in Section A. In enrolling for the Program, you consent to your contact email address being shared with other participants in the program for the purpose of facilitating group activities and meetings. If you have any questions or concerns, please contact us before the commencement of the Program. The workshops will also be recorded and made available to participants. By enrolling in the Program, you consent to be recorded for this purpose. Recording may not be shared with other people outside those enrolled in the Program.

Conduct: A high level of conduct by attendees is expected at all times. ROW reserves the right to expel an individual, without refund, from the Program if the ROW deems that individual’s behaviour to be aggressive, abusive, harassing, or otherwise inappropriate.

Force Majeure: ROW will not be liable for compensation for any matter or disruption outside its control (e.g. evacuations, road closures, pandemic, bad weather, earthquake or flight cancellations).

Intellectual property: All Program materials provided by ROW, including but not limited to the content of the course, slides, handouts, and any other materials, are the intellectual property ROW and are protected by copyright law. The materials are provided to the participant for personal use and may not be reproduced, distributed, or shared without prior written permission from ROW. The participant acknowledges and agrees that any unauthorized use or distribution of the materials may result in legal action being taken by ROW to protect its intellectual property rights. Any intellectual property rights in any work created by the participant during the course of the training program shall be owned by the participant.
